Acceptance of Terms
By accessing or using the Windy Network website (windy.network), APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services. We reserve the right to update these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
Description of Service
Windy Network provides financial market data through REST APIs, WebSocket streaming, FIX protocol, and MCP (Model Context Protocol) interfaces. Our Services include real-time and historical data for forex, cryptocurrency, and other financial instruments, as well as related tools, documentation, and support.
API Usage & Limits
Your use of Windy APIs is subject to the following conditions:
- API access is governed by the rate limits, quotas, and restrictions associated with your subscription plan.
- You must not exceed the rate limits assigned to your account. Exceeding limits may result in throttling, temporary suspension, or termination of access.
- API keys are confidential. You are responsible for all activity under your API key and must not share it with unauthorized parties.
- We reserve the right to modify API endpoints, data formats, and rate limits with reasonable notice.
Account Registration
To access certain features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of applicable laws or regulations.
- Redistribute, resell, or sublicense Windy data without prior written authorization.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Services.
- Interfere with or disrupt the integrity or performance of the Services, including through denial-of-service attacks or automated abuse.
- Misrepresent data sourced from Windy Network or remove any proprietary notices or attributions.
Intellectual Property
All content, data, software, trademarks, and other intellectual property associated with the Services are owned by Windy Network or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services and data in accordance with these Terms and your subscription plan. No rights are granted beyond what is expressly stated herein.
Limitation of Liability
To the fullest extent permitted by law, Windy Network and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to Windy Network in the twelve months preceding the claim. The Services and data are provided "as is" without warranties of any kind, express or implied.
Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. You may terminate your account at any time by contacting support. Any provisions of these Terms that by their nature should survive termination shall remain in effect.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
